Article 1 — Purpose and acceptance
These General Terms of Use (hereinafter 'GTU') govern access to and use of the PayeMesHeures service (hereinafter 'the Service'), an online working hours audit platform accessible at payemesheures.fr, published by VOIGHT-KAMPFF, a SARL with a share capital of 100 euros, RCS Creteil 823 547 526, registered office: 49 rue Charles Infroit, 94500 Champigny-sur-Marne.
Registration or use of the Service implies full and complete acceptance of these GTU. If you do not accept these terms, you must not use the Service.
By using this service, you acknowledge that PayeMesHeures is an automated analysis tool and does not constitute legal advice. Consult a lawyer for any contentious proceedings.
Article 2 — Description of the Service
PayeMesHeures is an online tool that enables employees to:
• Analyse their working hours by comparing them with the data on their payslips
• Detect potential discrepancies that may constitute breaches of French or Belgian employment law
• Generate documents (claim letters, summary files) that can be used in amicable or contentious proceedings
IMPORTANT: The Service is an automated analysis and calculation tool. It does not constitute legal advice, a lawyer's opinion or a legal consultation within the meaning of French law no. 71-1130 of 31 December 1971. The results provided are estimates based on data entered by the user. They cannot replace the advice of a lawyer specialising in employment law.
Article 3 — Registration and user account
Registration is free and reserved for adult natural persons (aged 18 or over) residing in mainland France, overseas departments and regions, or Belgium.
The user undertakes to provide accurate, complete and up-to-date information during registration. The user is solely responsible for the confidentiality of their login credentials (email and password). Any use of the account is deemed to have been made by the account holder.
In the event of suspected fraudulent use, the user must immediately inform VOIGHT-KAMPFF at contact@payemesheures.fr.
Article 4 — User obligations
The user undertakes to:
• Use the Service in accordance with its intended purpose, i.e. exclusively for the analysis of their own payslips or those for which they have express authorisation from the holder
• Not attempt to compromise the security, integrity or availability of the Service
• Not use the Service for illegal, fraudulent or immoral purposes
• Not impersonate a third party
• Not upload files containing viruses or malicious code
• Not resell or redistribute the analyses and documents produced by the Service for commercial purposes
• Not circumvent the technical limitations of the Service (credit quotas, rate limiting, authentication mechanisms)
Article 5 — Intellectual property
All elements comprising the Service — source code, algorithms, design, user interface, texts, document templates, databases, trademarks and logos — are the exclusive property of VOIGHT-KAMPFF and are protected by the French Intellectual Property Code.
Any unauthorised reproduction, representation or exploitation constitutes counterfeiting (articles L.335-2 et seq. of the CPI) and incurs the civil and criminal liability of its author.
Documents generated by the Service for the user (letters, files, reports) remain the property of the user. The user grants VOIGHT-KAMPFF a non-exclusive, free and limited licence to use anonymised and aggregated data for the purpose of improving the Service.
Article 6 — Personal data
The processing of the user's personal data is governed by our Privacy Policy, accessible from the 'Privacy' tab on this page.
By using the Service, the user acknowledges having read this policy. Uploaded payslips contain personal data that may be sensitive. VOIGHT-KAMPFF undertakes to process them with the utmost confidentiality, in accordance with the GDPR and the French Data Protection Act.

Article 7 — Limitation of liability
VOIGHT-KAMPFF uses reasonable means to provide reliable results. However, as analyses are performed by artificial intelligence on the basis of information provided by the user, VOIGHT-KAMPFF does not guarantee:
• The absolute accuracy of results and estimates
• That use of the Service will actually enable the identified amounts to be recovered
• Compliance of results with the case law applicable to the user's particular case
In any event, the liability of VOIGHT-KAMPFF, all causes combined, is limited to the amount actually paid by the user for the services concerned during the twelve (12) preceding months. This limitation does not apply in the case of serious or wilful misconduct.
The Service may be temporarily unavailable for maintenance, updates or force majeure reasons.

Article 8 — Suspension and termination
The user may delete their account at any time from the settings in their personal area. Deletion results in the permanent erasure of all their data (payslips, analyses, personal data) within thirty (30) days, subject to legal retention obligations.
VOIGHT-KAMPFF reserves the right to suspend or terminate, without notice or compensation, the account of any user in the event of: breach of these GTU; fraudulent or abusive use of the Service; provision of false or misleading information; breach of the Service's security.
Article 9 — Force majeure
VOIGHT-KAMPFF shall not be held liable for non-performance or delay in the performance of its obligations resulting from a case of force majeure as defined by article 1218 of the French Civil Code, including but not limited to: natural disasters, pandemics, acts of war or terrorism, strikes, power or telecommunications failures, hosting provider failures, cyberattacks, governmental or regulatory decisions.
Article 10 — Modification of GTU
VOIGHT-KAMPFF reserves the right to modify these GTU at any time. Any substantial modification will be notified to users by email at least fifteen (15) days before it comes into effect.
Use of the Service after the modifications come into effect constitutes acceptance of the new GTU. In the event of refusal, the user may delete their account.
Article 11 — Applicable law and jurisdiction
These GTU are governed by French law. In the event of a dispute, the parties will endeavour to seek an amicable solution. In the absence of an amicable agreement within thirty (30) days, the dispute will be submitted to the competent courts within the jurisdiction of VOIGHT-KAMPFF's registered office (Tribunal judiciaire de Creteil), unless mandatory jurisdiction in favour of the consumer applies in accordance with articles R.631-3 et seq. of the French Consumer Code.
