What does this calculation cover?
It covers wages or penalty and overtime rates that were not paid when they were due. In Australia, recovery can go back up to 6 years per pay period (Fair Work Act 2009, s.544).
What about interest?
Interest is left to the court (Fair Work Act s.547): the Fair Work Act sets NO statutory rate. Leave the interest field at 0 for the principal alone, or enter the rate a court might apply.
This calculation does not include
- The penalty rates in your modern award (night, weekend, public holidays).
- Unpaid superannuation (claim it with the ATO).
- Any civil penalties against the employer.
