Unpaid overtime in Ireland: what the law actually requires
There is no general statutory overtime premium in Ireland. Overtime rates and TOIL come from the contract, ERO or SEO. Unpaid extra hours are still wages under the Payment of Wages Act, and they can pull you below National Minimum Wage.
Contract, overtime clauses and time off in lieu
Employers must give core written terms within five days of starting work, including information about hours and pay. Check what counts as overtime and whether a higher cash rate or time off in lieu (TOIL) applies. See written terms within five days.
Some workplaces offer TOIL instead of cash. Both cash overtime and TOIL are contractual or policy choices, not a universal statutory premium. If TOIL was the deal, diary when the lieu time should have been given. TOIL that never arrives is still an unpaid-hours problem with a different label.
Sector overlays can set overtime or Sunday rates above the National Minimum Wage. Unpaid hours and the National Minimum Wage floor
Under the National Minimum Wage Act 2000, if someone works more hours than they are paid for, the average hourly rate must not fall below the legal minimum. From 1 January 2026, workers aged 20 and over are entitled to โฌ14.15 an hour (S.I. 472/2025 / WRC). Age 19 is โฌ12.74; age 18 is โฌ11.32; under 18 is โฌ9.91. Extra unpaid work stretches the hour count and can drag the average under โฌ14.15 even if the headline rate on the offer letter looked fine. "You are salaried so overtime does not exist" is not a complete answer if unpaid extras push you below the legal floor.
Evidence that holds up
Before you argue about "overtime law", open the paperwork:
- Written terms / contract: normal hours, overtime definition, rate or TOIL.
- Payslips: do overtime hours appear when pay varies with time worked? See payslips under the Payment of Wages Act.
- Rotas, clock records, messages: proof you were asked or expected to work the extra time. Employers must keep prescribed working-time records (often Form OWT1) for at least three years. Missing records can help your case: working-time records and the WRC.

What to do next
Calculate hours beyond normal, the contractual rate or TOIL terms, and an NMW average check. Raise it in writing with your employer. Must overtime always be paid at time and a half?
No. There is no general statutory overtime premium in Ireland. Higher rates come from the contract, a collective agreement, or a live ERO/SEO. Unpaid extra hours can still be wages at your normal rate, and they can breach National Minimum Wage.
Does a salary cancel overtime?
A salary is a payment method. It does not cancel a contractual overtime clause, and it does not cancel the NMW average check once unpaid extras count as hours.
Is the 48-hour week an overtime pay rule?

How long do I have to start a claim?
A WRC complaint is generally due within 6 months of the alleged contravention. The Adjudication Officer may extend that to 12 months where there is reasonable cause (Workplace Relations Act 2015 / WRC procedures). Protect the date early.
