Sector rates above the NMW in Ireland : calculate what you are owed
How Employment Regulation Orders and Sectoral Employment Orders set sector minimums above the National Minimum Wage, and how to reclaim underpayment via the WRC.
You clean a Dublin office block at the National Minimum Wage and assume that is the legal floor for everyone. A security guard in Cork hears a higher "industry rate." An early years educator in Galway is told the centre "follows NMW only." In Ireland, some sectors have extra statutory minimums above the national floor. Those rules are not one national "sector rate." They come from named Employment Regulation Orders (EROs) and, in other industries, Sectoral Employment Orders (SEOs). Exact euro figures change when a new Statutory Instrument (S.I.) is made. Always read the live Workplace Relations Commission (WRC) page and the S.I. for your sector before you calculate a shortfall.
In short
- An ERO sets statutory minimum pay and conditions for workers in a named business sector. A Joint Labour Committee (JLC) draws it up; the Labour Court adopts it; a ministerial order gives it legal effect (WRC; Citizens Information).
- An SEO (Industrial Relations (Amendment) Act 2015) can set pay, pension, or sick-pay rules after a Labour Court recommendation. Construction is the best-known SEO example; it is not the same track as an ERO.
- Citizens Information lists current ERO sectors including contract cleaning, security, and early learning and childcare. Coverage depends on the order's definition of the work.
- There is no single Ireland-wide sector rate. Each order has its own tables, grades, age bands, and start dates. Rates move by S.I.; check WRC and irishstatutebook.ie, not stale blog figures.
- The National Minimum Wage (NMW) remains the absolute floor. If an ERO line sat below NMW, the higher NMW entitlement prevails (Citizens Information; National Minimum Wage Act 2000).
- Underpayment of ERO terms can go to the WRC. Keep payslips, rotas, the workplace ERO notice, and a dated comparison against the live S.I.
What an Employment Regulation Order is
The WRC explains Joint Labour Committees as bodies under the Industrial Relations Acts that fix statutory minimum rates of pay and conditions for particular employees in particular sectors. A JLC has equal numbers of employer and worker representatives, plus a chair. JLCs often operate where collective bargaining is weak and wages tend to be low.
An ERO turns JLC proposals into binding law: drawn up by the JLC, adopted by the Labour Court, then given statutory effect by the Minister. Employers in the covered sector must pay wages and provide conditions not less favourable than those prescribed.
Citizens Information adds: if an ERO covers you, a notice explaining its terms should be displayed at work, and you can report breaches to the WRC. Employers must keep wage records for workers covered by an ERO and retain them for three years (WRC).
EROs sit beside your contract, the Payment of Wages Act 1991, Organisation of Working Time Act 1997 rules, and the National Minimum Wage Acts. Existing agreements that are equal or better can remain; an ERO is a sector floor, not a ceiling.
ERO, SEO, REA: do not mix the labels
| Instrument | Rough idea | Typical examples (check live) |
|---|---|---|
| ERO | JLC proposals become a ministerial order with sector pay/conditions | Contract cleaning; security; early learning and childcare |
| SEO | Labour Court recommendation on pay/pension/sick pay becomes law under the 2015 Act | Construction; mechanical engineering building services contracting |
| REA | Collective agreement registered with the Labour Court; binds the parties who subscribed | Named employers/unions on the Labour Court register |
Pain point: being paid adult NMW while an ERO or SEO grade rate for your role is higher. Paying NMW does not cure an ERO shortfall. A friend's "industry rate" from another sector does not create an ERO for you.
The National Minimum Wage is still the floor
From 1 January 2026, the adult national minimum hourly rate is €14.15 (S.I. No. 472/2025; WRC National Minimum Wage page). Age-related percentages apply under 20.
Citizens Information is explicit: even when hourly rates appear in an ERO, the employer must still pay at least the legal minimum wage. WRC contract-cleaning guidance repeats that rule for that sector. Where NMW is greater than an ERO rate, the NMW entitlement prevails.
Practical reading: compare the live NMW table and the live ERO/SEO table for your grade and age. You take the higher applicable statutory minimum for covered hours. Never assume "NMW compliance" equals "ERO compliance."
Example sectors (not a national rate list)
These are illustrations of the framework. Figures and dates change. Before you claim, open the WRC ERO (or SEO) page for the sector and read the S.I. on irishstatutebook.ie.
Contract cleaning (ERO)
WRC: the Employment Regulation Order (Contract Cleaning Industry Joint Labour Committee) 2025 took effect on 17 October 2025 and revoked the 2024 order. The WRC summary cites S.I. No. 430/2025. Coverage focuses on workers employed by undertakings providing cleaning and janitorial services in or on establishments such as hospitals, offices, shops, factories, apartments, hotels, and airports.
WRC publishes age-banded basic hourly rates with staged dates (including a further step from 1 January 2026). Read the euro amounts on that page and in the S.I., not from memory. The order also covers overtime after set weekly hours, unsocial-hours rules, sick-pay scheme terms, uniforms, and rosters.
Security industry (ERO)
Citizens Information lists a security-sector ERO (effective from 22 July 2025 in its overview). Department materials refer to instruments such as S.I. No. 326 of 2025 amending the Security Industry Joint Labour Committee order. Security orders often combine a minimum hourly rate with shift or unsocial premiums. Grades and dates sit on the WRC Security Industry ERO page and in the S.I. Recheck those whenever you hear a euro figure online.
Early learning and childcare (ERO)
Citizens Information: early learning and childcare EROs effective from 13 October 2025, split by role. It points to S.I. No. 477 of 2025 (for example Early Years Educators and School Age Childcare practitioners) and S.I. No. 478 of 2025 (for example Lead Educators / room leaders, SAC coordinators, deputy or assistant managers, centre managers, including graduate rates where provided). WRC's Early Learning and Childcare page summarises role rates and age bands. Do not apply a cleaner's or security figure to a room leader (or the reverse).
Construction (SEO, not an ERO)
Building-site roles may fall under a Sectoral Employment Order. WRC and the Labour Court publish construction SEO materials (including S.I. No. 207/2023 as amended, for example by S.I. No. 620/2024). Craft, operative, and apprentice classes, plus pension and sick-pay rules, are SEO territory. Same discipline: live WRC SEO page + S.I., never one invented "construction Ireland rate."
How to check coverage and calculate a shortfall
- Name the work and the employer's business. Coverage wording matters (for example contract cleaning vs in-house cleaning that may fall outside the order).
- Open the WRC ERO index, then Contract Cleaning, Security, or Early Learning and Childcare. For construction-type roles, open Sectoral Employment Orders.
- Note the S.I. number and commencement date; confirm on irishstatutebook.ie; see which earlier order is revoked or amended.
- Match your grade, age, and date of work. Many tables change mid-year or on 1 January.
- Look for the workplace notice; ask HR or your union which order they apply. A missing notice is a red flag; it does not prove you are uncovered.
- Compare payslips: basic hourly rate, premiums, and any sick-pay scheme terms the order requires.
Illustration only: an adult contract cleaner paid €14.15/hour (adult NMW from 1 January 2026) while the live WRC cleaning ERO table for that age and date shows a higher basic minimum. Shortfall per hour = ERO basic − rate paid (if ERO is higher). Multiply by hours at the wrong rate; add any missing premiums the S.I. required for hours actually worked. Plug in current WRC/S.I. figures for your dates. Security premiums and childcare graduate rates use different schedules. Ordinary retail is usually NMW + contract unless a specific order covers that job.
Evidence, WRC, and common traps
Useful evidence: contract and Day-5 core terms; photo of the workplace ERO notice; payslips; rotas and site sheets; job title and duties; PDF of the WRC sector page and S.I. for the weeks claimed; a dated email asking which order applies and for corrected pay.
Write first with role, dates, hours, the S.I. or WRC table, rate paid, and amount claimed. Report ERO breaches to the WRC for inspection or adjudication. SEO disputes often start with the local procedure in the order, then WRC, with Labour Court appeal routes as applicable. Mind the usual 6-month referral window (possible further extension for reasonable cause, commonly discussed up to 12 months maximum in WRC/Citizens Information guidance). Use the WRC, not a UK Employment Tribunal or ACAS.
Traps: treating NMW as the only minimum; inventing one national "sector rate"; using last year's cleaning figure for this year's security or childcare job; ignoring age bands or craft classes; assuming in-house cleaners automatically get the contract-cleaning ERO; confusing SEO with ERO; following UK National Living Wage blogs that are not Irish S.I.s.
Soft next step with Paye Mes Heures
If you are lining up rotas, payslips, and a date-by-date comparison against a printed WRC ERO or SEO table before you write to your employer or file with the WRC, Paye Mes Heures (payemesheures.fr) can help you organise hours, rates, and a shortfall table. It is a preparation aid, not Irish legal advice, and not an Ireland calculator as mature as the French product. Your live WRC sector page, the S.I., Citizens Information, the NMW floor, and (where needed) a union or adviser remain the anchors.
